Perishable Agricultural Commodities Act (PACA)
Licenses Required
The United States Department of Agriculture (USDA) has been sending letters to grocery retailers concerning their Perishable Agricultural Commodities Act (PACA) Licenses (click on the link below). The letter created some confusion for our members so we called the USDA to clarify. While grocery retailers and wholesalers are required to obtain a license if their invoice costs of fresh and frozen fruit and vegetable purchases exceed $230,000 in a calendar year the license application fee is $100. The retail and grocery wholesaler license is good for three (3) years. If the retailer renews their PACA license in a timely fashion there is not a renewal fee. If the retailer or grocery wholesaler does not timely renew their PACA license the retailer or grocery wholesaler will be required to reapply for their PACA license and repay the $100 PACA application.

We Card - It is the intent of the "We Card" program to become an FDA-approved training program. To that end, We Card has updated its training materials to align with current FDA regulation. Go to www.wecard.org to find out more about two training programs currently offered:
- We Card's Employee Training is a prerequisite for the Refresher Training Course; and
- A 20-minute Refresher Training Course requires employees to complete a set of interactive exercises focused on key elements of federal and state law.

Grocery Retailer Emergency Disaster Passes
Registration is now open! CFIC staff has been meeting with the Department of Emergency Management to improve the Emergency Disaster system, making revisions to the application process for passes allowing trucks, store managers and critical store personnel access to a store following an emergency/disaster.
Any grocery retailer registering for a pass will be provided with a password and be afforded access to North Carolina Emergency Management Division's WEB EOC and the opportunity to view all of the agency's emergency/disaster information in real time.

Fair Labor Standards Act
Many of our retail members employ youth during the summer months and during "after-school" hours. Federal employment laws differ for youth ages 17 and under (once an employee is 18, there are no federal child labor rules) and are established by the Fair Labor Standards Act (FLSA). This Act establishes minimum wage, overtime pay, recordkeeping, and child labor rules impacting full- and part-time youth workers in the private sector and in federal, state and local governments. The rules vary depending upon the age of the employee and his/her occupation.
